Last Updated: July 2026 — These binding legal clauses govern your access, responsibilities, and rights on our AI-assisted clinical decision support platform. Includes EU AI Act compliance and clinical governance provisions.
Premedice outputs are educational supports and NEVER replace independent clinical validation by certified practitioners. Do not use in emergency situations. AI outputs may contain inaccuracies or hallucinations — independent verification is mandatory.
Premedice operates in compliance with Regulation (EU) 2024/1689. Our AI systems are classified and assessed in accordance with the EU AI Act risk framework. See Section 9.
In these Terms, unless the context otherwise requires:
By accessing, registering for, or using the Platform in any capacity, you acknowledge that you have read, understood, and agree to be bound by these Terms and Conditions ("Terms"), our Privacy Policy, our Clinical Safety Framework, and any applicable Business Associate Agreement (BAA). These Terms constitute a binding legal agreement between you and Diagnostics AI, Inc.
If you are accepting on behalf of an entity (hospital, clinic, practice, research institution), you represent and warrant that you have the authority to bind that entity. If you do not agree, you must immediately halt usage.
We may update these Terms from time to time. Material changes will be communicated via email or in-app notification at least 30 days in advance. Continued use after the effective date of changes constitutes acceptance.
Premedice is a comprehensive AI-assisted medical information platform that provides the following services to licensed healthcare professionals, medical researchers, and authorized healthcare personnel:
Regulatory & Business Classification: Premedice is provided as a clinical decision support tool. It is not certified as a medical device under the EU Medical Device Regulation (MDR 2017/745), the FDA's Software as a Medical Device (SaMD) framework, or equivalent regulatory regimes unless explicitly stated. Premedice does not prescribe medications, sell prescription-only products, operate as an online pharmacy, provide telemedicine services, or engage in card-not-present sales of pharmaceuticals or regulated medical devices. The Platform is a SaaS-based clinical decision support system classified as such for payment processing and regulatory purposes. Users are responsible for determining the regulatory classification applicable to their use case.
AI Model Scope: Premedice exclusively uses text-based and clinical AI models for symptom analysis, lab report interpretation, and medical information retrieval. The Platform does not use, integrate, or offer generative image AI models (e.g., DALL-E, Midjourney, Stable Diffusion) or generative video AI models (e.g., Sora, Runway, Pika). No images or videos are generated by our AI systems. All AI outputs are text-based clinical analyses and structured medical information.
Registration requires a valid email address and authentication via Google OAuth or another supported identity provider. You must provide accurate and complete details, including professional credentials where applicable. Account sharing is strictly prohibited; each user must maintain separate credentials. You must notify us immediately at security@premedice.com of any unauthorized access. Multi-factor authentication is strongly recommended for all accounts and may be required for enterprise users.
You are responsible for maintaining the confidentiality of your login credentials and for all activities conducted through your account. We reserve the right to verify professional credentials and deny access where such verification is unsuccessful.
By using the platform, you represent that you are at least 18 years of age and are:
You will maintain appropriate professional liability insurance as required by your jurisdiction. You will not use the Platform as the sole basis for clinical treatment decisions. You acknowledge that Platform outputs require independent professional verification before any clinical application.
Subscription fees are billed in advance on a monthly or annual basis via Stripe. Subscription renewals are automatic unless canceled at least 24 hours prior to billing. Free tier accounts are subject to strict daily usage and API call limits as indicated on the pricing page. Enterprise customers may negotiate custom terms including dedicated support, enhanced SLAs, and custom data processing agreements.
All fees are exclusive of applicable taxes. You are responsible for withholding taxes where required. Late payments may incur interest at 1.5% per month or the maximum rate permitted by law. Refunds are governed by our separate Refund Policy available at /refund.
THE PLATFORM IS A CLINICAL DECISION SUPPORT TOOL — IT IS NOT A REPLACEMENT FOR PROFESSIONAL MEDICAL JUDGMENT.
• No Doctor-Patient Relationship: Use of the Platform does not create a physician-patient relationship or any fiduciary duty between you and Diagnostics AI, Inc.
• No Diagnosis or Prescription: The Platform does not prescribe medications, recommend specific treatments, or establish standards of care. All AI-generated outputs are strictly informational and educational.
• Not a Prescription-Only or Telemedicine Service: Premedice does not sell prescription-only products, operate as an online pharmacy, facilitate prescription fulfillment, provide telemedicine consultations, or engage in card-not-present sales of pharmaceuticals or regulated medical devices. The Platform is a SaaS clinical decision support tool only.
• Human Review Required: Every AI-generated recommendation, summary, analysis, or output must be independently reviewed, verified, and approved by a licensed healthcare professional before any clinical application.
• No Emergency Use: The Platform is not approved for use in emergency situations. In an emergency, dial 911 or call local emergency services immediately.
• AI Hallucination Risk: Large language models and AI systems can produce plausible but factually incorrect outputs ("hallucinations"), including fabricated medical citations, drug interactions, or clinical recommendations. You must independently verify all AI-generated medical information against authoritative sources.
• No Guarantee of Accuracy: We do not guarantee the accuracy, completeness, or clinical appropriateness of any AI-generated output. AI models may reflect biases present in training data, have knowledge cutoffs, or lack awareness of recent medical advances.
• Records Not a Substitute: The Platform does not constitute a complete medical record. You maintain your own independent patient records.
Our platform routes queries across a specialized ensemble of models (including Gemini, Claude, Med-PaLM 2, Med-Gemini, and MEDITRON-70B) to optimize response accuracy.
8.1 Model Disclosure. The specific AI model(s) processing your query may be displayed in the interface. Model selection affects output characteristics, accuracy, and limitations.
8.2 Non-Deterministic Outputs. AI outputs are non-deterministic — identical inputs may produce different outputs. Context window limitations may cause large records to be truncated or summarized automatically.
8.3 No Training on Your Data. Patient Data and prompts submitted to the Platform are NEVER used to train or improve third-party foundation models. We utilize zero-data-retention API endpoints where available.
8.4 Provenance Tracking. Where technically feasible, AI outputs include source attribution and citations. Citations from model knowledge alone are flagged [verify] and require independent confirmation.
8.5 Explainability. Upon request, we will provide information about the AI system's logic, capabilities, and limitations relevant to your use case, subject to applicable intellectual property protections.
8.6 Automated Decision-Making. The Platform does not engage in solely automated decisions that produce legal or similarly significant effects concerning users or patients, as defined in Article 22 of the GDPR. All AI outputs require human review before any clinical or legal action.
8.7 Knowledge Cutoff. AI models have knowledge cutoffs and may not reflect the most current medical evidence, guidelines, or regulatory requirements. You must independently verify timeliness of information.
Premedice complies with Regulation (EU) 2024/1689 (the EU AI Act) where applicable. The following provisions govern our AI systems:
9.1 Risk Classification. Our AI systems are assessed under the EU AI Act risk framework. To the extent any feature constitutes a high-risk AI system under Annex III, we conduct conformity assessments and maintain the required technical documentation prior to deployment.
9.2 Human Oversight (Art. 14). High-risk AI systems deployed on the Platform are designed with appropriate human oversight measures. Users are provided with the capability to override, reverse, or disregard AI outputs.
9.3 Transparency (Art. 50). Users are informed when they are interacting with an AI system. AI-generated content is labelled as such where technically feasible. Emotion recognition or biometric categorization systems, if deployed, are clearly disclosed.
9.4 Technical Documentation (Art. 11). We maintain technical documentation describing the design, development, and testing methodologies of our AI systems, available to competent authorities upon request.
9.5 Record-Keeping (Art. 12). Logs of AI system operations, including input data, output timestamps, and human oversight actions, are retained for the periods required by applicable regulations.
9.6 Accuracy, Robustness & Cybersecurity (Art. 15). Our AI systems undergo testing for accuracy, robustness against errors, and resilience to adversarial manipulation. Continuous monitoring is in place for drift detection and performance degradation.
9.7 Conformity Assessment. For any high-risk AI system, we perform a conformity assessment procedure and, where required, register the system in the EU database before deployment or placing into service.
9.8 AI Act Fines. Non-compliance with the EU AI Act may be subject to administrative fines. Users who deploy our AI systems in a manner inconsistent with these Terms or the AI Act bear responsibility for their own compliance.
10.1 Clinical Governance Framework. We maintain a Clinical Governance Framework to ensure the safe development, deployment, and monitoring of AI features used in clinical decision support.
10.2 Adverse Event Reporting. Users must report any adverse events, patient harm, or near-misses associated with Platform use to safety@premedice.com within 24 hours. We maintain an adverse event register and conduct root cause analyses for serious incidents.
10.3 Quality Management. Our quality management system includes regular audits, validation testing, version control of AI models, and documented change management procedures.
10.4 Clinical Validation. AI features are validated using appropriate datasets before deployment. Validation results, including performance metrics and known limitations, are documented and available upon request.
10.5 Monitoring & Drift Detection. We continuously monitor deployed AI systems for performance degradation, data drift, and concept drift. Significant changes triggering retraining or re-validation are documented.
10.6 User Training. We recommend that users complete available training materials on the appropriate use, limitations, and risks of AI-assisted clinical decision support before relying on Platform outputs.
You retain all right, title, and interest in and to all Patient Data, documents, and content you upload, input, or create using the Platform ("User Content"). We claim no ownership over your User Content and act solely as a data processor on your behalf as defined under applicable data protection laws.
You represent and warrant that you have obtained all necessary consents, authorizations, and legal bases required to upload, process, and share any Patient Data or personal information through the Platform, including but not limited to patient consent for the processing of health data.
